For which products can the right of withdrawal not be used?
Article 15 of the Distance Contracts Regulation sets out exceptions to the right of withdrawal. Custom-made goods prepared in line with the consumer's requests or personal needs, software and audio-video recordings whose packaging has been opened, products whose return is not suitable for hygiene reasons, and digital content performed instantly fall within this scope.
The main exceptions listed in art. 15 of the Regulation:
- Goods whose price depends on market fluctuations and is not under the seller's control.
- Goods prepared in line with the consumer's requests or clearly personal needs — custom-made boards, control units loaded with software specific to you, custom cable lengths or connector configurations fall into this group.
- Goods that spoil quickly or whose expiry date may pass.
- Products whose return is not suitable in terms of health and hygiene once the packaging has been opened.
- Audio/video recordings, books, software and programs whose packaging has been opened.
- Digital content and services performed instantly and delivered in electronic form.
