Within how many days at the latest must a faulty product be repaired?
For goods other than passenger cars and light commercial vehicles, the maximum repair time is twenty working days; the period starts to run when the fault is notified to the seller or the authorised service, so document the notification date in writing. If the period is exceeded, the consumer may request replacement with a fault-free equivalent or a refund. In addition, requests for free repair or replacement must be fulfilled within thirty working days at the latest.
Two different periods must not be confused with each other:
- Maximum repair time — twenty working days: this is the upper limit laid down for remedying a fault under warranty. The period runs from the date the fault is notified to the authorised service or the seller.
- Thirty working days: pursuant to Article 11/2 of Law No. 6502, this is the maximum period laid down for fulfilling a request for free repair or replacement with a fault-free equivalent.
If the twenty working day repair period is exceeded, your rights under Article 9 of the Warranty Certificate Regulation arise: you may request replacement with a fault-free equivalent or a refund. In addition, the time spent in repair is added to the warranty period.
