When does the warranty period start, and is time spent in repair added?
The warranty period starts on the date the goods are delivered to the consumer; the delivery date, not the purchase date, prevails. Under Article 6 of the Warranty Certificate Regulation, when the goods break down and stay in service, the time spent in repair is added to the warranty period. For this reason, document the service entry and exit dates.
Two points are frequently confused in practice:
- Start: the period runs from the delivery date. For products sent by courier the delivery date is proven by the courier delivery record; for this reason keep the delivery information.
- Extension: the time spent remedying the fault is added to the warranty period. That is, if your product stayed in service for ten business days, the warranty end date moves forward by ten business days.
The entry/exit document given to you during service work is the basis of this calculation; keep the document together with the warranty certificate. Issuing the warranty certificate is the manufacturer's or importer's obligation, while delivering it to the consumer is the seller's (Law 6502 art. 56, Warranty Certificate Regulation art. 5).
