Defective Goods
These are goods that do not have the quality agreed in the contract, that do not meet the features stated on the packaging or in the promotional material, or that are not fit for the purpose of use. The elective rights a consumer can use in this case are listed in Article 11 of Law No. 6502.
A defect does not only mean a device that does not work. The absence of a feature stated in the promotional material, a variant different from the one ordered being sent, or the expected performance of the product not being met also fall within the scope of a defect.
- Apparent defect: a deficiency or damage visible to the eye at the time of delivery.
- Hidden defect: a flaw that emerges with use and cannot be noticed at delivery.
- Legal defect: legal deficiencies that restrict the use of the goods.
It is important to make the notification without delay and to document it: when a photograph of the fault, the wiring diagram, a measurement of the supply voltage and the serial number are sent together, diagnosis speeds up. In industrial control products a significant proportion of faults originate from incorrect wiring or an unsuitable supply; in that case the problem arises not from a defect but from the installation. For this reason, going through the remote support step before opening a claim shortens both diagnosis and resolution.
